Penylvania adolescent demand on athlete transestimated by the federal judge

A teenager from Pennsylvania had her demand for having to face a Trans athlete against her secondary school dismissed by a federal judge.

Quakertoown Community High School High School ‘Cross-Country and Aislin Magalengo Athletics Corridor demanded the school and the Interscholastic Athletic Association of Pennsylvania (Piaa) at the beginning of this year. The lawsuit alleges that Magalengo was made to compete against a trans student in Plymouth Whitemarsh High School at a cross -country meeting in September 2024.

Allen won the first place in the match, while Magalengo arrived in second place. The lawsuit states that Magalengo continued to compete against Allen throughout the season.

The judge of the United States District Court, Wendy Beetlestone, dismissed the lawsuit on August 1. Beetlestone was appointed by former President Barack Obama in November 2014.

“His amended complaint lacks any objective accusation that he was subject to intentional discrimination, apart from stating so much in the most conclusive way,” Judge Wendy Beetlestone wrote in his decision. “She points out that there are no cases of women assigned to birth that are treated differently than the men assigned to birth, and, as such, she has not been able to declare a claim for discrimination based on sex.”

The lawyer of the plaintiffs, Keith Altman, said they will appeal the decision.

“The client is disappointed, obviously, and still firmly believes in what happened,” said Altman, according to NBC Philadelphia. “We will continue looking for the problem. We believe it is an extremely important problem and should be solved.

“It is irrefutable that men, as a general proposition, are more physically capable than women. We believe that it is fundamentally unfair than someone who simply says: ‘Well, I identify myself as a woman’ can now compete with women and master women’s athletes. It simply makes no sense.”
