The Biological Transgender Volleyball player Emma Morquecho is demanding to the University of Westcliff and the National Intercollegial Athlete Association (NAIA), an alternative university sports government agency to the NCAA, after claiming that an offer of scholarships was revoked and eligibility was denied.
The lawsuit was announced by the American Legal Legal Defense Civil Rights of the Educational Fund (Maldef).

“The Latin community is often the first to be directed under practices of irrational discrimination, and this case falls within that pattern,” said Maldef’s president and general advisor, Thomas A. Saenz, in a statement. “Discrimination, based on stereotype and false assumption, against trans athletes must end, especially in California, where many of the injured will be members of the largest racial/ethnic community in the state.”
Pak Gazette Digital has communicated with the University of Westcliff and La Naia to comment.
The lawsuit claimed that Morquecho revealed the athlete’s birth genre to university officials in 2022 and then received a scholarship offer. Morquecho alleges that on August 10, 2023, the head of the Westcliff’s female volleyball team sent an email saying that the athlete was not eligible to play that fall and that Westcliff revoked the scholarship.

“When I take a position, I am not only fighting for myself. I am speaking for each trans person who has been silenced, and I hope my voice feels others in our community to know their stories and their rights,” Morquecho said through Maldef’s statement. “Together, we can create a future where everyone is treated with dignity and respect.”
President Donald Trump signed the executive order to “keep men out of women’s sports” on February 5, lighting an offensive against men in women’s university sports. NCAA changed its gender eligibility policy the next day to exclude all biological men to compete in the women’s category.
However, the Naia had an advantage over that trend in April 2024, when it changed its gender eligibility policy.
The revised policy declared that all athletes can participate in male sports sponsored by Naia, but only athletes whose biological sex assigned at birth is a woman and that hormonal therapy has not begun can participate in women’s sports.
A student who started hormonal therapy can participate in activities such as training, practices and activities of the team, but not in interscholar competition.
Now, Morquecho is looking to challenge that rule in court.
