Appellants’ counsel asks court to provide them protection against CDA action
ISLAMABAD:
A bench of the Islamabad High Court (IHC), comprising Justice Azam Khan and Justice Raja Inam Amin Minhas, issued notice to the Capital Development Authority (CDA) on Monday regarding the intra-judicial appeal filed by the subtenants of 20 more apartments at One Constitution Avenue and sought its response.
During the hearing of the intra-judicial appeals of the 20 appellants, including former Air Chief Mujahid Anwar Khan and former Pakistan Cricket Board Chairman Ehsan Mani, the appellants’ counsel, Advocate Ali Raza, said that the rights of the appellants were affected by paragraph 30 of the IHC single judge’s decision.
He asked the court to declare the rights acquired by the appellants under the sublease legal and effective. He further set out the demands of the appellants, stating that the CDA should be prevented from interfering with the peaceful possession of the apartments by the appellants and that Article 30 of the single court’s decision should be set aside.

Noting the importance of the issue at hand, the lawyer noted that a Prime Minister’s committee had also been formed to investigate the One Constitution Avenue case. He also asked the court to issue an order on the protection of apartment owners in time, before the committee can say they cannot do anything on May 26, saying the next day is Eid. He expressed the appellants’ fear that the CDA may come to their apartments and ask them to evict them again.
In response, Justice Khan said they were issuing notice and asked CDA to file a reply on Wednesday.
